Design-build remodeling in Cupertino, CA.

Cupertino sits inside the area BayCraft serves. Design and construction stay under one roof, so a single team carries your project from the first conversation to the final walkthrough.

We build home additions, ADUs, kitchens, bathrooms and whole-home remodels for families across the South Bay and the Peninsula, working from Santa Clara under California contractor license #1158750. Permits, zoning research, plan submissions and inspections are handled by us, with whichever agency has jurisdiction over your address.

In Cupertino

What to know before you build here.

Cupertino writes many of its limits into the zoning letters on your parcel, so the first step is reading your zone. Second stories come with floor ratio, setback and privacy planting rules that shape the design. An ADU over 800 square feet starts counting against your floor area, and we check all of this before a concept is drawn.

01

Your zoning suffix can cap you at one story

Single-family zoning in Cupertino comes with suffixes that change what you can build. In an R1-i Single Story Overlay district, the residents chose to limit homes to one story and 18 feet. R1-e covers an Eichler area with its own building design requirements and design handbook. R1-a is a semi-rural district with its own regulations. Every R1 parcel is built or remodeled under the R1 Ordinance, and one-story and two-story homes follow different processes. We confirm the zone before anyone sketches a second story.

What sends a second story to design review

The City consulting architect reviews any second story larger than 66% of the first floor, or closer than 15 feet to an interior side property line. If the two side setbacks add up to less than 30 feet, the second story needs Residential Design Review. A notice board must stay up on site during the public comment period. Some second-story windows face side or rear neighbours, have a sill 5 feet or lower, and use clear or opening glass. Those need privacy planting within a 30-degree view cone unless the neighbour signs a waiver.

Oaks and cedars are protected from 12 inches

Cupertino protects specimen trees once a single trunk reaches 12 inches in diameter, or 24 inches combined for a multi-trunk tree, measured 4.5 feet above ground. Specimen species include native oaks, California buckeye, big leaf maple, western sycamore, bay laurel, and deodar and blue atlas cedars. Trees required by an earlier permit and privacy planting trees are protected too. A removal needs a permit with public notice, plus replacement trees or an in-lieu fee. The City says a retroactive permit after removal costs far more than applying first.

Stay at 800 square feet to protect your floor area

In Cupertino, an ADU of 800 square feet or less is exempt from lot coverage, floor area ratio and open space limits. It can sit 4 feet from the side and rear property lines. Above 800 square feet, it counts against all three limits. Units under 750 square feet skip park, storm drain and school impact fees. A second-story ADU is allowed only as a conversion of existing living space. A JADU of up to 500 square feet must be carved out of the house, not the garage, and must still fit within the 45% floor area ratio.

We handle the submissions, but if you want to ask something before we speak, Cupertino runs a Planning Division on planning@cupertino.gov and 408-777-3308. Requirements on this page are from the city's own planning pages and can change, so we re-check them per address.
